Terms of Use

Welcome to the "FunTainan" Cultural Tourism Digital Stamp Platform (hereinafter referred to as "the Platform"), operated by STARBIT Innovation and guided by the Cultural Affairs Bureau, Tainan City Government. Before using the Platform, please carefully read the following Terms of Use (hereinafter referred to as "these Terms"). By registering and beginning to use the services of the Platform, you are deemed to have thoroughly reviewed, understood, and agreed to these Terms and to comply with their provisions. The Non-Fungible Tokens (NFTs or digital certificates) developed and owned under these Terms are solely for digital collection purposes. The Platform does not directly provide transaction, exchange services, or secondary market auctions for digital certificate holders. STARBIT Innovation reserves the right to amend the contents of these Terms, other terms of service, and operating rules. Such amendments will be announced on the Platform at the time of the change. Continued use of the services provided by the Platform by members will be deemed as acceptance of the amended content. If a member does not agree to the amended content, they have the right to cease using the services provided by the Platform. Upon cessation of service use, the member is not entitled to request the Platform to continue providing any services or fulfill any other obligations, including but not limited to retaining or providing any information from the member's original account. The termination of these Terms does not affect the right of the non-breaching party to pursue liability for breach of contract from the breaching party.

You are required to register on the Platform and provide truthful, accurate, and complete personal information. Please promptly update your account information if there are any changes. To the extent permitted by law, you agree that the Platform may use your information and cookies to comply with relevant legal requirements or mandatory provisions of relevant laws. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. If you become aware of any unauthorized use of your account, you must immediately notify the Platform. You will have an exclusive digital certificate wallet address on the Platform (hereinafter referred to as the “Wallet”). The Wallet is maintained and safeguarded by a third-party custodian partnered with the Platform and is solely for the storage and transfer of digital certificates. The digital certificates you collect will be stored in the Wallet provided by the third-party custodian, or you may choose to transfer the digital certificates to an external wallet owned by you.

When using the Platform, you must comply with the laws and regulations of Taiwan as well as the relevant norms and policies of the Platform. The digital stamps and/or digital certificates you obtain on the Platform are limited to reasonable personal, non-commercial use and must not be transmitted, distributed, or made available to the public in any form. The moral rights, copyright, and any physical ownership (if applicable) of the digital stamps and digital certificates belong to the respective creators, artists, or the Platform. You must comply with all relevant copyright laws when using these items. Without the consent of the respective creators, artists, or the Platform, you must not reproduce, sublicense, or use the content of the digital certificates for commercial purposes. The Platform is provided to you on an “as-is” basis. The Platform reserves the right to modify any or all service features at any time. The Platform makes no express, implied, or statutory warranties, claims, or declarations regarding its services. The Platform reserves the right to temporarily or permanently modify or discontinue the services (or any part thereof) at any time, with or without notice. You agree that the Platform shall not be liable to you or any third party for any modifications, suspensions, or discontinuations of the services. You must not use the Platform to engage in any illegal activities, infringe upon the rights of others, or disrupt public order or morals. The Platform reserves the right to terminate or temporarily suspend your access to all or part of the Platform’s services under any of the following circumstances, including but not limited to: 1. Uploading, displaying, disseminating, or storing any content that is illegal, obscene, indecent, inappropriate, promotes terrorism, racial discrimination, or hate speech. 2. Infringing on the intellectual property rights or other rights of others. 3. Publishing false or misleading information or statements. 4. Interfering with, disrupting, or circumventing the security measures of the Platform in any manner. 5. Engaging in any other activities that the Platform deems inappropriate use of an account. 6. Based on legal enforcement or requests from other government agencies, if the Platform is required to take legal action, it will be at the sole discretion of the Platform.

1. When collecting digital stamps and digital certificates on the Platform, you must carefully read all the information regarding the content. You must fully accept and agree to the content before proceeding with the collection of stamps. 2. You may view the collection records of your digital stamps and the digital certificates stored in the Wallet managed by the Platform at any time. 3. When collecting digital certificates on the Platform, you are not required to pay any handling fees. 4. You may choose to withdraw and transfer the digital certificates from the Wallet to an external wallet owned by you. 5. The Platform will not charge any handling fees for withdrawals to other digital platforms. However, please note that once the digital certificates are withdrawn and transferred out, they cannot be transferred back to the Platform.

1. Depending on the country in which you reside, you may not be able to use all the features of this website. If your country or region excludes all or part of the content of these Terms, please do not use the services of the Platform. 2. The Platform may cease to provide relevant services at any time due to force majeure, changes in laws or policies, or other factors beyond the control of the Platform.

The validity, interpretation, application, and dispute resolution of these Terms of Use shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan). Any disputes, controversies, or differences arising from the use of this website, services, or violation of these Terms of Use shall first be negotiated in good faith by both parties. If negotiations fail and litigation ensues, both parties agree that the Taiwan Tainan District Court shall be the court of first instance.
